SimuCheck Terms of Use

SimuCheck and SimuCheck:::CONNECT are products of undoLogic Inc. ("undoLogic", "we", "us", "our"). These Terms of Use apply to anyone who creates a SimuCheck account, downloads or uses the SimuCheck:::CONNECT client, or uses the SimuCheck website, bug tracker, or feature request board ("you", "your").
By creating an account, clicking "I agree", or using SimuCheck, you agree to these terms. If you do not agree, please do not use SimuCheck.
These terms are specific to SimuCheck. undoLogic's general terms for client contract work do not apply to your use of SimuCheck.
1. What SimuCheck is
SimuCheck lets you connect joysticks, sliders, buttons, and other input devices to supported simulators (currently Train Sim World) and remap how they control the game. It consists of:
- the SimuCheck website, where you create and manage your simulators, configurations, and account; and
- the SimuCheck:::CONNECT client, a program you download and run on your own Windows computer, which reads your input devices, sends commands to your simulator, and connects to the SimuCheck service.
2. Early access and free trial
SimuCheck is currently in early access. This means:
- The software is still being developed. It may contain bugs, behave unexpectedly, change, or lose features or settings as it evolves.
- Access may be opened gradually, in small groups, at our discretion.
Early access is a free trial. During the trial:
- You can use SimuCheck free of charge.
- The trial is for a limited time. We will tell you by email, in advance, when the trial is ending.
- SimuCheck will become a paid service, with pricing to be announced.
- You will never be charged automatically. When paid plans begin, you will only pay if you actively choose to subscribe. If you do not subscribe, your access to paid features simply ends. There is no obligation and you can stop at any time.
Paid subscriptions, when available, will be subject to these terms plus the plan details shown at the time you subscribe.
3. Your account
- You must provide accurate information, including a working email address, so we can contact you about your account, early access, and changes to these terms.
- You are responsible for keeping your login and your SimuCheck key file secure. Your key file links the CONNECT client to your account. Do not share it.
- You are responsible for activity on your account.
- You must be at least the age of majority where you live, or have the permission of a parent or guardian who agrees to these terms on your behalf.
4. Your licence to use SimuCheck
SimuCheck, the CONNECT client, the website, and all related code, designs, and documentation are owned by undoLogic Inc. They are licensed to you, not sold.
Subject to these terms, we give you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the CONNECT client on computers you own or control, and to use the SimuCheck website, for your own personal use.
You agree not to:
- copy, sell, rent, sublicense, share, or redistribute the CONNECT client or your key file;
- share your account or key with other people;
- reverse engineer, decompile, disassemble, or attempt to extract the source code of the client, except where the law expressly allows it despite this restriction;
- modify the client, remove its notices, or create derivative works from it;
- interfere with, overload, probe, or attempt to bypass the security of the SimuCheck service;
- use SimuCheck for anything illegal, abusive, harmful, or deceptive, including cheating in a way that breaks another game's rules or online services.
We may require you to update the CONNECT client to keep using SimuCheck.
5. Use at your own risk
SimuCheck sends input to your simulator and runs on your computer. You understand and agree that:
- SimuCheck is provided "as is" and "as available", especially during early access.
- You are responsible for your computer, your input devices, your simulator installations, and your saved games and settings. Keep your own backups.
- SimuCheck may produce unexpected input, for example a control moving to an unexpected position. Test new configurations carefully.
- We do not guarantee that SimuCheck will be uninterrupted, error-free, compatible with every device or simulator version, or that it will meet your expectations.
6. Third-party games and services
SimuCheck works with games, platforms, and services made by other companies, such as Train Sim World, Windows, Discord, and YouTube.
- SimuCheck is not affiliated with, endorsed by, or sponsored by Dovetail Games or any other simulator publisher. Train Sim World and other names are trademarks of their respective owners and are used only to describe compatibility.
- Your use of those games and services is governed by their own terms. You are responsible for following them.
- We are not responsible for changes, outages, updates, or policy changes made by third parties, including changes that stop SimuCheck from working with a game. Where possible, we will try to adapt, but we cannot guarantee it.
7. What you submit: bugs, feature requests, and shared setups
SimuCheck includes a public bug tracker, a public feature request board, and community spaces such as our Discord server.
- Public content. Bug titles and descriptions, feature request titles and descriptions, and the number of people who seconded a feature are visible to other users. In future, the usernames of people who submitted or seconded an item may also be shown. Do not include personal or sensitive information in these.
- Private diagnostic data. When you submit a bug, we automatically attach diagnostic information (for example your client version, simulator, devices, configuration, and recent logs). This is visible only to us and is used to fix problems. See section 8.
- Your ideas. If you suggest a feature, improvement, or idea, or share a configuration or setup, you give undoLogic a free, worldwide, perpetual, irrevocable licence to use, adapt, and build on it in SimuCheck or any other undoLogic product, without payment, credit, or any obligation to you. We are under no obligation to build any feature that is requested or seconded.
- Your content stays yours. You keep ownership of what you submit; you simply give us the licence above.
- You confirm you have the right to share what you submit, and that it does not break any law or anyone else's rights.
- We may edit (for example, to clarify a title), merge, hide, or remove submissions at our discretion.
8. Privacy and data
To provide SimuCheck, we collect and process some information, including your account details (such as your email), your simulator configurations, and data sent by the CONNECT client when it connects to our service (such as client version, connection status, input device information, and logs).
Your simulator's local API key stays on your computer and is not sent to SimuCheck.

9. Changes to SimuCheck
We may add, change, limit, or remove features, supported simulators, or devices, or discontinue SimuCheck, especially during early access. If we discontinue SimuCheck, we will try to give reasonable notice.
10. Changes to these terms
We may update these terms from time to time. When we do:
- we will publish the new version with a new version number and effective date;
- for material changes, we will notify you by email or in SimuCheck at least 30 days before the change takes effect, describing what is changing;
- you will be asked to review and accept the new version before continuing to use SimuCheck;
- if you do not accept the new version, you may stop using SimuCheck and close your account at any time, at no cost.
11. Suspension and ending your access
- You may stop using SimuCheck at any time. You may ask us to close your account by contacting us.
- We may suspend or end your access if you break these terms, misuse SimuCheck, create a security or legal risk, or if required by law. Where reasonable, we will tell you why.
- When your access ends, your licence to use the CONNECT client ends, and you must stop using it.
- Sections 4 (ownership), 5, 6, 7 (licence to your ideas), 12, and 14 continue to apply after your access ends.
12. Limitation of liability
To the extent permitted by law:
(a) Cap. Except as provided in paragraph (c), undoLogic's total liability to you for all claims relating to SimuCheck or these terms, whether contractual, extra-contractual, or otherwise, will not exceed the greater of (i) the total amount you paid to undoLogic for SimuCheck in the twelve (12) months before the event giving rise to the claim, or (ii) CAD $100.
(b) Excluded damages. Except as provided in paragraph (c), undoLogic is not liable for indirect, incidental, consequential, or special damages, or for loss of data, saved games, settings, profits, or enjoyment.
(c) Exceptions. Nothing in these terms excludes or limits undoLogic's liability for gross or intentional fault, for bodily or moral injury caused to another, or for any liability that cannot be excluded or limited under the laws of the Province of Québec or other law that applies to you.
13. Your rights as a consumer
If you are a consumer, you may have rights under the consumer protection laws of the place where you live that cannot be waived or limited by a contract. Nothing in these terms takes away those rights. If any part of these terms conflicts with such a right, that right prevails.
14. Language, governing law, and disputes
Langue du contrat. Les parties reconnaissent qu'une version française des présentes conditions et des documents qui s'y rattachent leur a été remise et qu'elles ont eu l'occasion de l'examiner. Après avoir examiné cette version française, les parties expriment leur volonté expresse d'être liées uniquement par la version anglaise des présentes conditions et de tous les documents qui s'y rattachent, y compris les avis et autres communications. Les présentes conditions sont régies par les lois de la province de Québec.
Language of the contract. The parties acknowledge that a French version of these terms and their related documents was made available to them and that they had the opportunity to examine it. Having examined that French version, the parties expressly wish to be bound solely by the English version of these terms and all related documents, including notices and other communications. These terms are governed by the laws of the Province of Québec.
The courts of the judicial district of Montréal, Québec, have jurisdiction over any dispute, subject to any mandatory law that gives you the right to bring proceedings in the place where you live.
Before starting any proceeding, please contact us first. Most issues can be solved quickly by talking.
15. General
- Force majeure. We are not responsible for delays or failures caused by events outside our reasonable control, including power or internet outages, provider outages, cyberattacks, illness, emergencies, natural disasters, government action, or third-party platform changes.
- Severability. If any part of these terms is found invalid or unenforceable, the rest continues to apply, and the invalid part will be interpreted as closely as possible to its original intent in a lawful way.
- Entire agreement. These terms, together with the Privacy Policy and any plan details shown when you subscribe, are the entire agreement between you and undoLogic about SimuCheck.
- Assignment. You may not transfer your account or these terms. undoLogic may transfer them as part of a reorganisation, merger, or sale of SimuCheck.
